Duties

This position is located in the Office of Small Business and Civil Rights (SBCR), Civil Rights and Diversity Directorate (CRDD).

The successful candidate will perform the full range of the duties described below. The duties include but are not limited to:

1. Provide authoritative advice, recommendations and actions on a wide variety of EEO and civil rights related issues.

2. Process informal and formal discrimination complaints filed under various civil rights laws to include counseling and investigating complaints, preparing letters of acceptance/dismissal, investigating and issuing determinations on spin-off complaints and settlement breach allegations, and overseeing the work of contract mediators, investigators or others in compliance with EEO complaint processing rules and regulations as set forth in 29 CFR Part 1614.

3. Provide technical guidance and assistance to EEO counselors to facilitate resolution of cases, and to ensure that all matters raised during counseling are correctly defined and properly addressed, and all counseling documents are completed accurately and submitted to the necessary parties.

4. Develop and provide training for EEO counselors and staff. Facilitate and coordinate requests for Alternative Dispute Resolution.

5. Prepare various reports on the status of EEO activities such as the No Fear Act Report to Congress and the Annual 462 report to the Equal Employment Opportunity Commission utilizing iComplaints or other relevant software systems.

Qualifications

The ideal candidate will be able to demonstrate the following:

1. Demonstrated extensive knowledge and understanding of Federal equal employment opportunity laws, rules, regulations, and procedures for processing complaints of discrimination.

Example: Describe specific training, experience, and developmental assignments which enabled the candidate to acquire and apply knowledge of Federal equal employment opportunity laws, rules, regulations, and procedures for processing complaints filed under Title VII of the Civil Rights Act of 1964, as amended (Title VII), the Rehabilitation Act of 1973, as amended, the Equal Pay Act (EPA) of 1963, as amended, the Age Discrimination in Employment Act (ADEA) of 1967, as amended, and the Genetic Information Nondiscrimination Act of 2008 and other relevant statutes.

2. Demonstrated ability to analyze data and issues, and recommend solutions based on sound judgment.

(Example: Describe specific training, experience, and developmental assignments which demonstrate the candidate's ability to review and evaluate data and issues using analytical techniques, draw conclusions from analysis, and recommend effective solutions to decision making officials.)

3. Demonstrated ability to plan, organize, and coordinate a program.

(Example: Describe specific training, experience, and developmental assignments which demonstrate the candidate's ability to plan, organize, and coordinate the activities of a program, the ability to identify and obtain resources and services needed to carry out program operations, coordinate the efforts of persons engaged in program activities, and promote a program to organizations or groups of people.)

4. Demonstrated ability to view situations from different perspectives, and maintain a neutral and fair viewpoint in order to address and resolve sensitive issues.

(Example: Describe specific training, experience, and developmental assignments which demonstrate the candidate's ability to view sensitive issues from an unbiased perspective and recommend fair and equitable solutions.)

5. Demonstrated ability to communicate effectively both orally and in writing.

(Example: Describe specific training, experience, and developmental assignments which demonstrate the candidate’s ability to effectively communicate information before managers and employees at all levels, and defend analyses, findings, and proposals before decision making officials, both orally and in writing.)

You must have at least one year of specialized experience at the next lower grade level or equivalent in the Federal service or possess equivalent experience in the private or public sector.

SPECIALIZED EXPERIENCE is defined as: Experience as a Civil Rights/EEO Specialist or Attorney. Examples of applicable specialized experience are: EEO and employment law experience; drafting letters of acceptance and dismissal, drafting and reviewing settlement agreements or settlement breach allegations; conducting EEO Counseling; reviewing and approving investigative plans; conducting EEO investigations pursuant to EEOC guidelines; preparing annual EEOC 462 Report and/or NO FEAR Act Report to Congress Report; experience with alternative dispute resolution programs and/or conducting training for employees and managers on federal sector EEO issues.

The U.S. Nuclear Regulatory Commission (NRC) is an independent agency that was established by the Energy Reorganization Act of 1974 and began operations in 1975.
