Summary:
This position is located in the Division of Administration in the Office of the General Counsel. This position is located in Rockville, MD. This position is not in the Bargaining Unit. Occasional travel is required. Travel expenses associated with the interview expenses will not be paid. Relocation expenses associated with job offer may be paid.

Responsibilities:
The incumbent is expected to represent the agency in administrative litigation and provide legal labor relation, employee relations and equal employment opportunity opinions and advice to officials in the United States Nuclear Regulatory Commission (NRC). The incumbent supports the Assistant General Counsel for Administration by representing NRC in its capacity as employer in complaints, appeals, and grievances before administrative agencies including the Equal Employment Opportunity Commission (EEOC), Merit Systems Protection Board (MSPB), Federal Labor Relations Authority (FLRA), and arbitrators. The incumbent will support the Department of Justice (DOJ) and various United States Attorneys in litigation involving the NRC in employment law-related cases filed in the federal courts. The incumbent is expected to represent the NRC in, among others, adverse, disciplinary, and performance-based actions; arbitrations; grievances; individual right of action appeals alleging whistleblowing; reduction in force actions; unfair labor practice charges; negotiability appeals and representation petitions; EEO complaints and appeals; interaction with the Office of the Special Counsel in allegations of whistleblowing retaliation and other alleged prohibited personnel practice actions; and personnel security cases. The incumbent will serve as legal counsel to the collective bargaining team with the agency's exclusive representatives. The incumbent will also advise NRC management on a wide array of personnel law related issues.
Duties will be performed with substantial independence, requiring the exercise of sound judgment and minimal supervisory oversight.
Selectee will be subject to Office of Government Ethics Confidential Financial Disclosure reporting requirements and the NRC’s Prohibited Securities Rule.

Qualifications:
The ideal candidate will be able to demonstrate the following:
1. Demonstrated knowledge and experience related to federal labor-management relations laws, regulations and practice before the Federal Labor Relations Authority addressing a wide array of issues under Chapter 71 of the Civil Service Reform Act ,and experience negotiating and/or interpreting collective bargaining agreements.
2. Knowledge and experience related to federal employee relations laws, regulations, and practice before the U.S. Merit Systems Protection Board, including issues related to Chapters 23, 43, and 75 of the Civil Service Reform Act.
3. Knowledge and experience related to federal equal employment opportunity laws, regulations and practice before the Equal Employment Opportunity Commission, including issues related to Title VII of the 1964 Civil Rights Act, as amended; the Age Discrimination and Employment Act; the Rehabilitation Act of 1973, as amended; the Americans with Disabilities Act, as amended; and other civil rights laws dedicated to ensuring equal employment opportunity and promoting diversity in the federal government.
4. Demonstrated ability to represent federal agencies in administrative hearings and appeals before various employment law-related tribunals including the FLRA, MSPB, EEOC, arbitrators, and the federal courts, or other litigation experience including adjudication of personnel security matters.
5. Demonstrated ability to conduct and direct complex legal research; engage in sound legal analysis; and present the results in a clear, concise, and persuasive manner, both in writing and verbally to clients, supervisors and other federal officials.

In order to qualify for this position, you must have at least one year of specialized experience at the next lower grade level in the Federal service or equivalent experience in the private or public sector. Specialized experience includes experience that demonstrates a broad knowledge and understanding of legal principles in the area of federal personnel, equal employment opportunity, labor relations, or administrative law and demonstrated experience preparing written legal memoranda, briefs, or opinions in judicial or administrative matters on these topics.

Education:
You must be a graduate of an accredited law school with a J.D., LL.B., or equivalent degree, and you must be an active member in good standing of the Bar of a state or territory of the United States or the District of Columbia.

To begin work at the NRC without a security clearance, you must be granted a temporary waiver of the required clearance, referred to as a "145(b) waiver." To be eligible for a 145(b) waiver you will need a favorable education verification, reference, credit, and criminal history checks. If a wavier is granted, the successful completion of a background investigation and favorable adjudication is required for continued employment. If you have resided outside the U.S. for an extended period of time, the agency may not be able to (1) grant the 145(b) waiver where the required investigation cannot be completed in a timely manner, or (2) achieve timely completion of the background investigation required for a security clearance.
